Trump's Framework of Consequences and Incentives

The ex-president's insatiable urge for payback has rapidly morphed into a structured system. Over the year since his election, the chief executive's anger and whims have taken on the shape of official policies similar to analogous to past authoritarian systems. Justice department personnel who do not cooperate are promptly fired and replaced by devotees. Political officials who challenge him encounter indictment, trial and punishment. Critics have been labeled under executive memoranda as “anti-American”, “anti-Christian” and “anti-capitalist”, and menaced with legal action as “extremists”.

Federal Agencies Restructured

Each situation involving legal action of Trump's enemies and immunity for supporters exhibits its own particular characteristics. However, notwithstanding their specific nature, they exemplify manifestations of what has arisen as a calculated method. Those events are far from random. The administration's purge of DoJ attorneys and law enforcement officials, alongside his appointment of supporters in key positions, started quickly, promptly assumed a regularity, and has now been molded into a system. The justice department and the FBI have been remade into ideological agencies under his clear direction to execute his directives. Unfairness has been turned into standard. It constitutes the retribution system.

Administration is preoccupied with penalizing the President's alleged adversaries than they are with defending our national security.

Within the Apparatus

The origin of this mechanism has been revealed in the court filing of several previous top FBI executives lodged in September in the US district court in DC against agency head Kash Patel and justice department head Pam Bondi for unlawful firing in “a campaign of revenge against Plaintiffs for what the accused considered to be a refusal to demonstrate adequate allegiance”. In the complaint that Brian Driscoll, the ex- acting FBI director, details a conversation in which Patel “openly acknowledged the unlawfulness of his behavior”.

He had attempted to protect agency personnel from being terminated, the filing alleges. Patel told him that “they” – perceived by the official to be the presidential administration and federal prosecutors – had directed him to fire all those who they identified as having been involved in a law enforcement case against him. The filing continues: “Patel stated that he had to fire the personnel his superiors told him to remove, because his capacity to keep his own role was contingent on the ouster of the agents who were involved in cases involving the leader. Patel commented that there was no way he or him could do to halt these or any other firings, because ‘the FBI tried to put the leader in prison and he hasn't forgotten it.’” Once Driscoll informed Patel he was disregarding the agency's own policies, the director reportedly said “he recognized that and he was aware the essence of the immediate dismissals were almost certainly improper”.

Widespread Impact

Following his reported acknowledgment to Driscoll, the justice department and the Federal Bureau have been gutted and repurposed for Trump's retribution system. Six of the agency's senior executives were dismissed or compelled to leave in the first days of the administration. Roughly numerous lawyers at the justice department have accepted a “deferred resignation program”. A minimum of several federal prosecutors, such as those in the Manhattan division, quit in protest over what they regarded as ideological pressure in withdrawing the legal action against the local official, the mayor, in return for his collaboration with Trump's ICE roundups of foreign nationals. The ethics division of DoJ, which manages corruption cases, has been cut down to a handful of lawyers. The rights protection unit has been devastated: 70% of its personnel has left. A third of executives at DoJ have quit. The section upholding environmental law has lost half its leadership.

Rewards and Penalties

In the legal matter, the interim prosecutor for the NY office, the official, quit in protest against what she described as the “trade-off”. The border official, the president's “immigration leader,” showed up as the implementer with him on television to state: “Should he fail to deliver, I'll reappear in the city.”. Additionally, another figure, formerly the justice department figure and a former Trump attorney, who negotiated the deal, was granted an court role, a likely springboard to the judicial branch.

The president's immunity for crimes committed while in government, granted by the extraordinary decision of the conservative on the highest court, thus blocking his criminal case over the political violence and safeguarding his electoral prospects for the 2024 election, is the cornerstone on which he relies to defend his stalwarts. With such immunity, he has been freed to permit corruption. The consequence of the court judgment permeates his presidency and the political party down to its bones. The legal case has metastasized. In the words of Richard Nixon's White House counsel he said about the Watergate
